Amend the resolve by striking out the title and substituting the following:
‘Resolve, Directing the Department of Health and Human Services To Adopt Rules Governing the Use of Certain Antipsychotic Drugs by Children Enrolled in MaineCare’
Amend the resolve in section 1 in the 2nd line (page 1, line 2 in L.D.) by striking out the following: "amend its" and inserting the following: 'adopt'
Amend the resolve in section 1 in the last line (page 1, line 9 in L.D.) by inserting after the following: "Adolescents." the following: 'Rules adopted pursuant to this resolve are major substantive rules as defined in the Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A.'
summary
This amendment clarifies that the Department of Health and Human Services must adopt rules pertaining to the use of atypical antipsychotic medications by a child under 17 years of age enrolled in MaineCare. The department does not currently have rules pertaining to the use of atypical antipsychotic medications by a child under 17 years of age enrolled in MaineCare. Rules adopted are designated major substantive rules as defined in the Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A.
