An Act To Prohibit the Sale and Purchase of Human Fetal Tissue
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 22 MRSA §1593-A is enacted to read:
§ 1593-A. Sale and purchase of human fetal tissue
1. Prohibition. The sale and purchase of human fetal tissue is prohibited in accordance with the provisions of this subsection. For purposes of this subsection, "human fetal tissue" means tissue or cells obtained from a human embryo or fetus after an abortion.
A. A person may not accept money or anything of value for human fetal tissue.
B. A person may not offer money or anything of value for human fetal tissue.
2. Consenting, aiding or assisting. A person may not consent to violating subsection 1 or aid or assist another in violating subsection 1.
3. Penalty. A person who violates this section commits a Class C crime. Violation of this section is a strict liability crime as defined in Title 17-A, section 34, subsection 4-A.
