An Act To Improve Access to Home-based and Community-based Care in the MaineCare Program

Sec. 1. 22 MRSA §3174-WW  is enacted to read:

§ 3174-WW.  Reimbursement for services for home-based and community-based waiver programs

In the administration of the federal Medicaid waiver programs for home-based and community-based services for the elderly and for adults with disabilities, the department shall make available to MaineCare members coverage for medically necessary health care services and services provided under the applicable waiver for at least 95% of the cost of providing services in a nursing facility for that member.

This bill provides that Department of Health and Human Services coverage for services to a member who is served under one of the home-based and community-based care waiver programs in MaineCare must be at least 95% of what it would otherwise cost to provide such services to the member if the member were served in a nursing facility.
