An Act To Require That Carbon Monoxide Detectors Be Installed inside Educational Facilities

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 25 MRSA §2468, sub-§2-A  is enacted to read:

2-A Carbon monoxide detectors in educational facilities.   The owner of an educational facility shall install, or cause to be installed:
A In an educational facility existing on the effective date of this subsection, carbon monoxide detectors:

(1) On the ceiling of any room containing a permanently installed fuel-burning appliance;

(2) In a central location of every habitable level; and

(3) In each part of the facility that is on an individually controlled zone of a heating, ventilation or air conditioning system.

Carbon monoxide detectors installed pursuant to this paragraph must be installed according to manufacturer's specifications and may be powered by any method that is in accordance with National Fire Protection Association Standard 720 or a successor standard; and

B After the effective date of this subsection, in an educational facility constructed or substantially renovated, as defined in Title 20-A, section 15908-A, subsection 1, a building converted to an educational facility or an addition exceeding 3,000 square feet to an educational facility, carbon monoxide detection and warning equipment. The carbon monoxide detection and warning equipment must be installed in accordance with National Fire Protection Association Standard 720 or a successor standard.

For purposes of this subsection, "educational facility" means a structure used for elementary or secondary education by at least 6 persons for at least 4 hours per day or more than 12 hours per week. "Educational facility" includes portable, temporary classroom space as defined in Title 20-A, section 15672, subsection 21-B.

This bill requires carbon monoxide detectors or carbon monoxide detection and warning equipment to be installed in educational facilities, defined as structures used for elementary or secondary education. The owner of an existing educational facility is required to install carbon monoxide detectors in specific areas of the facility. The owner of an educational facility constructed or substantially renovated or to which an addition in excess of 3,000 square feet is made after the effective date of this legislation is required to install carbon monoxide detection and warning equipment.
