An Act To Prohibit Sale or Possession of Synthetic Cannabinoids

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 17-A MRSA §1101, sub-§16-B  is enacted to read:

16-B   "Synthetic cannabinoid" means any chemical compound that is chemically synthesized and either:
A Has been demonstrated to have binding activity at one or more cannabinoid receptors; or
B Is a chemical analog or isomer of a compound that has been demonstrated to have binding activity at one or more cannabinoid receptors.

For the purposes of this subsection, "chemical analog" means any chemical that is substantially similar in chemical structure to another chemical compound.

Sec. 2. 17-A MRSA §1102, sub-§4, ¶F,  as enacted by PL 2011, c. 428, §7 and affected by §9, is amended to read:

F. JWH-018, JWH-073, HU-210 and HU-211 and any other synthetic cannabinoid.

summary

This bill defines "synthetic cannabinoid," commonly known as "spice" or "K2," in general terms and lists it as a schedule Z drug. Current law only lists specific chemical compounds that are synthetic cannabinoids, so chemical compounds that are synthetic cannabinoids but differ from the compounds listed in statute are not considered schedule Z drugs and are legal in the State.
