An Act To Provide Transparency in Public-private Partnerships for Transportation Projects
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 23 MRSA §4251, sub-§10, as enacted by PL 2009, c. 648, Pt. A, §1, is amended to read:
10. Public records. All records, notes, summaries, working papers, plans, interoffice and intraoffice memoranda or other materials prepared, used or submitted in connection with any proposal to be considered under this subchapter are confidential and not subject to public review until the department determines that the proposal meets the standards of this public records for the purposes of Title 1, chapter 13, subchapter or until the proposal is finally rejected by the department 1.

Under current law, materials used or submitted in connection with a proposal for a public-private partnership for a transportation project are confidential. This bill provides that those materials are public records.
