Amend the bill in section 1 in subsection 5-A in the 2nd line (page 1, line 4 in L.D.) by inserting after the following: " prospecting" the following: ' as long as the provisions of this subsection are met'
Amend the bill in section 1 in subsection 5-A in paragraph C in subparagraph (2) in the first line (page 1, line 15 in L.D.) by striking out the following: " 6" and inserting the following: ' 7'
Amend the bill in section 1 in subsection 5-A in paragraph C in subparagraph (3) in the first line (page 1, line 16 in L.D.) by inserting after the following: " nozzle" the following: ' and hose'
Amend the bill in section 1 in subsection 5-A by striking out all of paragraph G (page 2, lines 1 to 13 in L.D.) and inserting the following:

Motorized recreational gold prospecting is prohibited within the following areas:
(1) Waters closed to motorized recreational gold prospecting in the unorganized territories identified in rules adopted by the Department of Agriculture, Conservation and Forestry, Maine Land Use Planning Commission; and
’ (2) Waters closed to motorized recreational gold prospecting identified in rules adopted by the Department of Environmental Protection.
Amend the bill by striking out all of section 2 (page 2, lines 14 to 21 in L.D.) and inserting the following:
‘Sec. 2. Rulemaking. The Department of Environmental Protection and the Department of Agriculture, Conservation and Forestry, Maine Land Use Planning Commission may each adopt rules identifying specific waters in which motorized recreational gold prospecting is not allowed. Rules adopted pursuant to this section are routine technical rules as defined in the Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A.
Sec. 3. Authority to submit legislation. The Joint Standing Committee on Environment and Natural Resources may report out a bill related to motorized recreational gold prospecting to the Second Regular Session of the 126th Legislature.’
SUMMARY
This amendment changes the horsepower and hose size of the equipment that may be used in motorized recreational gold prospecting. It strikes the provision of the bill that identifies waters where motorized recreational gold prospecting is prohibited and replaces it with authorization for the Department of Environmental Protection and the Department of Agriculture, Conservation and Forestry, Maine Land Use Planning Commission to adopt rules identifying specific waters in which the activity is not allowed. The amendment also authorizes the Joint Standing Committee on Environment and Natural Resources to report out a bill related to motorized recreational gold prospecting to the Second Regular Session of the 126th Legislature.
