Amend the bill in section 1 in §13090-L in subsection 3-B in the 5th line (page 5, line 18 in L.D.) by inserting after the following: " in writing." the following: ' The department may deny a certificate for any reason. The department may not approve a certificate that qualifies the visual media production or major visual media production for a tax credit under Title 36, section 5219-Y or 5219-II, respectively, in excess of the funds appropriated for those purposes.'
SUMMARY
This amendment provides the Department of Economic and Community Development the discretion to deny a certificate for a visual media production or a major visual media production. The department is required to deny a certificate if it would qualify the production for tax credits in excess of the funds appropriated for that purpose.
