Amend the bill by striking out the title and substituting the following:

‘An Act To Make Persons with Certain Drug Convictions Ineligible for TANF Assistance’

Amend the bill in section 1 in paragraph D in the last 2 lines (page 1, lines 5 and 6 in L.D.) by striking out the following: " been convicted of a felony drug offense" and inserting the following: ' a disqualifying drug conviction'

Amend the bill in section 3 by striking out all of subsection 17-A and inserting the following:

17-A Denial of assistance based on a disqualifying drug conviction.   An individual who has a disqualifying drug conviction after August 22, 1996 is not eligible for TANF assistance. As used in this subsection, "disqualifying drug conviction" means a conviction that, at the time of conviction, is punishable by imprisonment for one year or more under any law of the United States or of any state and that has as an element the possession, use or distribution of a controlled substance as defined in Section 102(6) of the federal Controlled Substances Act, 21 United States Code, Section 802(6) or a scheduled drug as defined in Title 17-A, section 1101, subsection 11. "Disqualifying drug conviction" does not include conviction of a crime under the laws of another state that is classified by laws of that state as a misdemeanor and is punishable by a term of imprisonment of 2 years or less. This subsection must be applied retroactively to current recipients of and applied to new applicants for TANF assistance.

Amend the bill by adding after section 5 the following:

Sec. 6. Appropriations and allocations. The following appropriations and allocations are made.

SUMMARY

This amendment, which is the minority report of the committee, replaces the term "felony drug offense" with "disqualifying drug conviction."

The amendment also adds an appropriations and allocations section.
