An Act Concerning Learner's Permits
Emergency preamble. Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and
Whereas, there is some confusion over the authority of entities other than the Secretary of State to issue the documentation for a learner's permit and to administer the examination necessary to obtain a learner's permit; and
Whereas, it is in the best interests of the State to clarify the authority for these duties as soon as possible; and
Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,
Sec. 1. 29-A MRSA §1304, last ¶, as enacted by PL 2013, c. 381, Pt. B, §16, is amended to read:
A learner's permit issued under this section may be issued only by the Secretary of State. Only the Secretary of State may collect and process an application and the fees for a learner's permit and administer any required examination.
Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.

This bill clarifies that only the Secretary of State may collect and process an application and the fees for a learner's permit and administer any required examination.
