An Act To Restore to Jimmy J. Soucy the Right To Maintain Existing Structures on Property in Sinclair
Sec. 1. Property of Jimmy J. Soucy in Sinclair. Notwithstanding the requirements of the Maine Revised Statutes, Title 12, chapter 206-A and the conditions of a Consent Order entered into on May 1, 2012 in the case of State of Maine and Maine Land Use Regulation Commission v. Jimmy J. Soucy, Superior Court, Kennebec County Docket No. CV-12-10, with regard to property deeded to Jimmy J. Soucy and his heirs and assigns by the State of Maine and recorded in the Aroostook County Registry of Deeds, Book 1487, Page 158 and Book 1536, Page 264 and described in state property tax records as T17, R4 WELS, Sinclair, Aroostook County, Map AR021, Plan 04, Lot 83.2, .25 acres +/- with building, the following conditions apply:
1. Structures. The structures existing on the property on May 1, 2012 must be considered, for all purposes, a permissible use and may be maintained for residential purposes for the use of Jimmy J. Soucy, his heirs and assigns as long as the structures exist on the property in livable condition. In the event of natural deterioration or damage, the structures may be maintained and repaired as long as there is no expansion of the use of the property or the size of the structures. Any expansion or change of use of the existing structures is subject to approval by the Maine Land Use Planning Commission;
2. Time limitation. The conditions specified in the Superior Court Consent Order that the existing structure may be maintained on the property only for the life of Jimmy J. Soucy and the life of his wife, or until December 31, 2040, and requiring demolition of the property after that date may not be enforced; and
3. Other conditions. Conditions of the Superior Court Consent Order regarding the water source and usage, wastewater disposal, electrical hookup and vegetative buffer for the property that is the subject of the Consent Order may be enforced by the Maine Land Use Planning Commission.
SUMMARY
This bill specifies the permissible uses of certain property in Sinclair and structures on that property acquired by Jimmy J. Soucy in 2009 from the State of Maine.
