An Act Regarding Enforcement of Commercial Vehicle Laws
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 29-A MRSA §555, sub-§4, ¶F is enacted to read:
F. A state police officer or motor carrier inspector designated in paragraph D may not disseminate information from a report prepared in connection with a roadside inspection of a motor carrier subject to this subchapter if a warning, rather than a summons, is issued for a violation of rules adopted by the department that adopt by reference federal regulations found in 49 Code of Federal Regulations that is not an out-of-service order as defined in section 558, subsection 1-A.

This bill prohibits a state police officer or motor carrier inspector from disseminating information from a report prepared in connection with a roadside inspection of a motor carrier if a warning, rather than a summons, is issued for a violation of United States Department of Transportation, Federal Motor Carrier Safety Administration regulations that is not an out-of-service order.
