An Act To Provide Toll Discounts to Maine Commuters on the Maine Turnpike

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 23 MRSA §1973, sub-§4,  as amended by PL 2011, c. 476, §4, is further amended to read:

4. Rates.   The rate of toll at each toll facility may be revised from time to time in accordance with this subsection.
A-1. The authority is prohibited from imposing variable surcharges based on the time of day.
A-2 The authority shall establish a system of commuter discounts to provide passenger vehicles with reduced rates that may not exceed 50% of the normal passenger vehicle toll.
B. A reduction in the rates of fees, fares and tolls may be given to any class of vehicle based upon volume of use.
C The rate of toll must be based on the number of miles traveled.

Prior to the implementation of any revision to the rates of fees, fares or tolls, the authority shall submit its proposed revisions to the joint standing committee of the Legislature having jurisdiction over transportation matters. After receipt and review of the proposed revisions, the joint standing committee may submit legislation to the Legislature authorizing, rejecting or modifying the authority's proposed revisions to the rates of fees, fares or tolls.

This bill amends the laws governing the establishment of the rates of tolls on the Maine Turnpike as follows.

1. It restores language that was repealed in Public Law 2011, chapter 476 requiring that the system of commuter discounts established by the Maine Turnpike Authority provide passenger vehicles with reduced rates that do not exceed 50% of the normal passenger vehicle toll.

2. It requires that the rate of toll be based on the number of miles traveled.

3. It requires that, prior to implementing toll revisions, the authority must submit its proposed revisions to the joint standing committee of the Legislature having jurisdiction over transportation matters and authorizes the committee to submit legislation to the Legislature authorizing, rejecting or modifying the authority's proposed revisions.
