Resolve, Directing a Study of the Creation of a Fire and Emergency Services Academy

     Emergency preamble. Whereas, Acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and

     Whereas, funds necessary to accomplish the study created by this resolve will lapse unless this resolve is effective immediately; and

     Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore, be it

     Sec. 1. Maine Fire Protection Services Commission directed to study creation of central fire fighting training academy. Resolved: That the Maine Fire Protection Services Commission, within existing resources, shall conduct a study of the following:

     1. The need for a central fire fighting training academy in the State; and

     2. If it finds there is need for a central fire fighting training academy in the State, where the academy would most appropriately be located and the feasibility of establishing it, including the feasibility of creating a unified state fire and emergency medical services academy housed and administered as part of the Maine Criminal Justice Academy; and be it further

     Sec. 2. Conduct of study. Resolved: That the Maine Fire Protection Services Commission, in conducting the study described in section 1, shall consult with any agency, organization or person in order to adequately undertake the study; and be it further

     Sec. 3. Report. Resolved: That the Maine Fire Protection Services Commission shall submit a report to the Joint Standing Committee on Criminal Justice before January 1, 2002 of the commission's findings, conclusions and recommendations resulting from the study required under section 1. The commission may include in the report suggested legislation to implement its recommendations; and be it further

     Sec. 4. Authority to report out legislation. Resolved: That the Joint Standing Committee on Criminal Justice may report out to the Second Regular Session of the 120th Legislature legislation relating to the creation of a central fire fighting training academy in the State; and be it further

     Sec. 5. Certain funds not to lapse. Resolved: That, notwithstanding Public Law 1999, chapter 731, Part AAAA, section 4, any unexpended appropriations to the Maine Fire Protection Services Commission pursuant to Public Law 1999, chapter 731, Part AAAA, section 4 do not lapse but must be carried forward to fiscal year 2001-02 and may be used to carry out the purposes of this resolve.

     Emergency clause. In view of the emergency cited in the preamble, this resolve takes effect when approved.

Effective May 16, 2001.
