Resolve, Authorizing the Adjutant General to File a Finalized Declaration of Covenants and Restrictions with the Kennebec County Registry of Deeds in the Veterans' Memorial Cemetery Located on the Mount Vernon Road in Augusta Preamble.
Whereas, the Department of Defense, Veterans and Emergency Management acquired a parcel of land on the Mount Vernon Road in Augusta for a new veterans' memorial cemetery on August 17, 1998; and
Whereas, the Department of Environmental Protection reviewed the proposal to develop a veterans' memorial cemetery under the site location of development natural resources protection laws and issued a Water Quality Certification Findings of Fact and Order dated January 18, 2000 that ordered the Department of Defense, Veterans and Emergency Management, Bureau of Maine Veterans' Services to file a finalized Declaration of Covenants and Restrictions for the compensation area, referencing the final construction plans, with the Kennebec County Registry of Deeds prior to June 30, 2000. Evidence of filing must be submitted to the Department of Environmental Protection, Bureau of Land and Water Quality, Division of Land Resources Regulation within 30 days of the filing date. Evidence consists of copies of the restrictions stamped with the book and page numbers or accompanied by a letter from the register of deeds; and
Whereas, the Department of Defense, Veterans and Emergency Management, Bureau of Maine Veterans' Services is without authority to record a finalized Declaration of Covenants and Restrictions in state land; and
Whereas, the Department of Environmental Protection has agreed to extend the time period until June 30, 2001 to file the Declaration of Covenants and Restrictions; now, therefore, be it
Sec. 1. Record interest. Resolved: That the Adjutant General shall record a finalized Declaration of Covenants and Restrictions in the land located on the Mount Vernon Road in Augusta that Lucille T. McGuire conveyed to the State by deed dated August 17, 1998 and recorded in Book 5729, page 274 of the Kennebec County Registry of Deeds to comply with special condition #6 of the Department of Environmental Protection Order #L-20153-26/31-A/B-N to the Department of Environmental Protection for the Veterans' Memorial Cemetery.
