§23. Unauthorized use of electronic benefits transfer system
1.
Unauthorized spending of benefits.
A recipient may not use the electronic benefits transfer system established under section 22 to effect any transaction in:
A.
A retail establishment where 50% or more of the gross revenue of the establishment is derived from the sale of liquor as defined in Title 28‑A, section 2, subsection 16;

B.
A gambling facility, as defined in Title 8, section 1001, subsection 16, except that use of the electronic benefits transfer system is permitted in any portion of the premises of a gambling facility that is set aside separately for the sale primarily of staple foods as defined in 7 United States Code, Section 2012(r); or

C.
A retail establishment that provides adult-oriented entertainment in which performers disrobe or perform in an unclothed state for entertainment.

2.
Rulemaking.
The department shall adopt rules to implement this section. Rules adopted under this subsection are routine technical rules as defined in Title 5, chapter 375, subchapter 2‑A.
